APPLICATION under Article 263 TFEU for the annulment of Commission Decision C(2017) 3051 final of 2 May 2017 on a request for confidential treatment pursuant to Article 8 of Decision 2011/695/EU of the President of the European Commission of 13 October 2011 on the function and terms of reference of the hearing officer in certain competition proceedings (Case AT.39610 — Power Cables).


1        By letter lodged at the Court Registry on 5 July 2018, the applicants informed the Court in accordance with Article 125 of the Rules of Procedure of the General Court that they wished to discontinue proceedings.

2        By letter lodged at the Court Registry on 19 July 2018, the defendant submitted observations on the discontinuance of the proceedings and requested that the applicants be ordered to pay the defendant’s costs.

3        Article 136(1) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings is to be ordered to pay the costs if they have been applied for in the other party’s observations on the discontinuance.

4        The case shall therefore be removed from the register and the applicants ordered to pay the costs, including those relating to all the proceedings for interim measures.

On those grounds,

THE PRESIDENT OF THE EIGHTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T423/17 is removed from the register of the General Court.

2.      Nexans France and Nexans shall pay the costs, including those relating to all the proceedings for interim measures.
